Asbestos Law
Asbestos Management and Removal Company Ltd are licensed by the Health & Safety Executive to manage the removal of asbestos.
If you own, occupy, manage or have responsibilities for premises which may contain asbestos, you have a legal duty to manage the risk from asbestos or a duty to co-operate with whoever manages that risk. It is YOUR duty to manage asbestos, NOT the landlord's, YOURS as the occupier. You may find that your insurance company may insist that you have your premises surveyed for asbestos.
The law requires those responsible for workplace premises to do the following:
- Have an asbestos survey of the premises carried out.
- Find out if the asbestos is present and assess it's condition.
- If in doubt, presume a material is asbestos.
- If asbestos is present have samples laboratory tested.
- Assess the potential risk.
- Prepare and implement a plan to manage the risk.
- Decide what to do and take appropriate action.
- Review and monitor the plan periodically.
- Provide information to anyone liable to come into contact with the asbestos.
The penalties for non-compliance can be severe:
- Companies can be fined an unlimited amount.
- Individuals can be fined £20,000.
- Health and Safety Inspectors have the power to issue a prohibition notice and close your site.
- Responsible individuals can be imprisioned for up to two years.
- Directors can be disqualified.
